Preamble
Definitions
The Consortium is the MERIL-2 Consortium, as defined in the MERIL-2 Consortium Agreement. The Consortium partners are as follows:

Content is all data, software, databases, metadata as well as any other intellectual work that could be the subject of copyright regardless of whether the protection period has lapsed or the use falls under the copyright exceptions and which is accessible from the website of the Consortium’s Website.
Use is any and all types of access to the MERIL-2 Website.
User is anyone using the MERIL-2 Website.
Registered User is any user who registers for the services offered by the Consortium through the Website and consents for the processing of his/her personal data exclusively for the offering of value added services.
Services are all processing functions based on digital technologies serving user needs.

The Consortium has received funding from the European Union’s Horizon 2020 research and innovation program under grant agreement No 654296.
Fair Terms of Use Policy
The Consortium is committed to openness and transparency and aims at protecting the interests of the user. Bearing in mind that commitment, it will only use fair terms and notify the user for any change of the terms of use of its website and services.
Intellectual Property Rights and Licensing Issues
The MERIL database and portal are the property of the Consortium as stipulated in the Consortium Agreement.
The content of the MERIL portal, including the MERIL logo, the UI, the various images and icons of the portal, the text of the portal etc. is available through the Services of the Portal to users/visitors only in accordance with the terms of the Creative Commons Attribution No Derivatives NonCommercial 4.0 International Licence (CC-BY-NC-ND).
The informational content of the MERIL portal, i.e. the data and metadata that describe the informational entities of the portal (RIs, persons, services, equipment, organizations, networks and nodes) are published under the terms of the Creative Commons Attribution 4.0 International licence (CC BY 4.0).
Authorized users may upload to the MERIL portal images, logos and other files. These files, that follow the data and the descriptions of the informational entities of the portal (namely: RIs, persons, services, equipment, organizations, networks and nodes), are excluded from the licenses stated above and may be subject to copyright restrictions such as Non Commercial-No Derivatives 4.0 Generic (CC BY-NC-ND 4.0) licence.
The software used for the development and operation of the Website is Free/ Open Source Software and is made available through licences that comply with the definitions of the Free Software Foundation and the Open Source Initiative.
The specific licence under which content or software is made available through the Website is explicitly specified to the end-user per software package.
The Website content or software may be made available through Graphic User Interface that allows the user to view, edit and download it or through web-services and Open Application Programming Interfaces to which access is allowed in accordance with these Terms of Use in order to download data or meta-data in accordance with the licences specified above.
Any other work protected under intellectual property law which is licensed using licences different from those above mentioned must be expressly and specifically be identified as such.
Responsibility
Non-commercial use of data exported from the MERIL database is permitted, provided that MERIL is clearly credited as the source of the data as mentioned in the Conditions of Use section below.
This site includes links to external web sites, mostly those of research infrastructure (RI) included in MERIL. These links give users direct access to more in-depth and detailed information about an RI and its access rules. However, the ESF and MERIL partners are not responsible for the content of these Internet sites. The inclusion of links does not imply endorsement or agreement with views expressed on external webpages.
The information provided on this website is not contractual and is for general information purposes only. We will not be liable for loss or damage arising in connection with the use of this website or any of the websites to which this website provides links. Users of this website and of the information it contains recognize that any use made of any information or materials contained in this website is done under the user’s full and sole responsibility.
This website reflects the views of the MERIL-2 project and not necessarily those of the European Commission. The European Commission is not responsible for any use of the information found on this website.
Any dispute arising from use of this website is subject to the laws of Belgium.
Privacy
The European Science Foundation may change this policy in compliance with European or French law by updating this page. You should check this page from time to time to ensure that you agree with any changes. This policy is effective from 01/09/2016.
What we collect
On certain parts of the website, we may ask you to provide information about yourself in order to allow us to contact you, or to provide services you request. This information could include the following items:
- Name
- Job title
- Employer
- Employer address
- Contact information including email address and postcode
We require this information for the following reasons - To know who to contact for questions or information update requests regarding an RI
- To provide a contact person for researchers who would like to get in touch with an RI
- To keep internal records
- To reply to a contact email
- We may periodically send MERIL-related newsletters or emails, or other information which we think you may find interesting using the email address which you have provided.
We never provide any information to third parties for commercial use.
Security
We are committed to ensuring that your information is secure. In order to prevent unauthorized access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online.
Cookies
A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.
We use traffic log cookies to identify which pages are being used. This helps us analyse data about webpage traffic and improve our website in order to tailor it to user needs. We only use this information for statistical analysis purposes and then the data is removed from the system.
A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.
You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. Data Protection
In accordance with European directives and with French Law No. 78-17 of January 1978 on information processing, electronic files and civil liberties, the MERIL-2 web site and database have been declared at the Commission Nationale de l'Informatique et des Libertés (CNIL), which is the independent French administrative authority protecting privacy and personal data. Within this framework and according to the Regulation EU N° 2016/679 of the European Parliament and of the Council of 27 April 2016 , all persons registered in the database have a right to access and update the personal information about them and to ask for such information to be modified or deleted by contacting meril[at]esf.org.
Direct access to the information stored in the MERIL database is restricted to staff of ESF, MERIL consortium partners, National Data Intermediaries, MERIL Advisory Committee Members, and RI coordinators (each to varying degrees depending on role permissions). The data will, under no circumstances, be passed on to third parties for commercial purposes.
The information MERIL collects is also used to compile statistics and analytical reports.

Conditions for use of MERIL data
The use of this Website, including web crawling, caching or any other use of services offered through it, is conditioned upon the unreserved acceptance of the Terms of Use (ToU) described henceforth and is construed as acceptance of these Terms of Use.
Use of this Website is allowed for legitimate purposes only, in accordance with these Terms of Use and in a way that does not restrict or limit its use by third parties. The User's actions or omissions must not cause damage or malfunction to the Website or have any negative effect or risk to the regular provision of the Website services offered to its users.
MERIL information/data is provided in good faith, on a best efforts basis, and while the Consortium tries to keep the information timely and accurate, it will not be responsible for any omissions, oversights, or errors. Users recognize that any use made of any data provided by MERIL is done under the user’s full and sole responsibility. The European Science Foundation, MERIL partners, and/or the European Commission will not be responsible for any prejudice or damages of any type, direct or indirect, resulting in part or in entirety, from the use of this data.
The following text must appear wherever MERIL data is used or reproduced (where multiple options are listed, separated by “/” please choose the one that applies to you):

Wherever MERIL data is used or reproduced, the MERIL project would like to receive a copy of the public version of the document/report/presentation/analysis produced (please send to meril[at]esf.org).
Reproduction or use of any MERIL data or content by any third party for commercial purposes is prohibited.
